Në procesin e mashtrimit me makineri ndërtimi me vlerë milionëshe, Gjykata e Landit në Braunschweig ka dënuar dy persona me disa vite burg . “Veprat kanë shkaktuar dëme të mëdha”, është shprehur gjyqtari të mërkurën në aktgjykimin e tij.
I akuzuari kryesor, një shtetas 37-vjeçar i Kosovës është dënuar me pesë vjet burg, ndërsa bashkëpunëtori i tij 36-vjeçar, po ashtu nga Kosova, me dy vjet e shtatë muaj burg.
Dy të dënuarit kanë kërkuar falje pak para shpalljes së vendimit, shkruan Agjencia Gjermane e Lajmeve DPA. Procesi gjyqësor është shkurtuar ndjeshëm falë një marrëveshjeje në të cilën dy të akuzuarit kanë pranuar pothuajse në tërësi të gjitha deliktet e tyre.
I akuzuari kryesor ka vepruar midis dhjetorit 2019 dhe korrikut 2021 në mbarë Gjermaninë, në grupime të ndryshme me bashkëpunëtorë të ndryshëm. Siç është zbuluar gjatë procesit, ai është kontrolluar dhe monitoruar për një kohë të gjatë përpara se të bëhej goditja.
Me një rrjet kompanish, emra fiktivë dhe pasaporta të falsifikuara, ai merrte me qira, ndër të tjera, miniekskavatorë, ngarkues me rrota dhe makineri tjetër. Mirëpo, makineritë në fjalë ai nuk i ka kthyer, por i ka dhënë me qira ose i ka shitur.
37-vjeçarit i është gjetur në pronësi të paligjshme edhe një armë zjarri me municion. Atij i janë dëshmuar 38 vepra në proces – ndërsa bashkëpunëtorit të tij i është dëshmuar përfundimisht pjesëmarrja në rreth 16 vepra.
Në fillim të procedurës, prokuroria publike kishte raportuar rreth 100 raste të njohura, për vetëm disa prej të cilave kishte akuza. Prokurori ka vlerësuar se dëmi total i mundshëm është të paktën 1.4 milionë euro.
Në rrjedhën e marrëveshjes lidhur me pranimin e veprës nga dy të akuzuarit, procedimi përfshinte një dënim nga pesë deri në pesë vjet e gjysmë burg për autorin kryesor dhe një dënim nga dy vjet e gjashtë muaj deri në dy vjet e nëntë muaj për bashkëpunëtorin.
Prokuroria publike dhe mbrojtja më pas kanë dorëzuar kërkesat e tyre në këtë kuadër, transmeton albinfo.ch. Vendimi nuk është ende ligjërisht i detyrueshëm. Rishikimi është i mundur.
Të dënuarit duhet të dëbohen pas vuajtjes së burgut. Dy burrat nga Kosova edhe ashtu po qëndronin ilegalisht në Gjermani.
