I akuzuari e ka pranuar dënimin me gjobë me kusht por ka kundërshtuar dëbimin pesë-vjeçar nga Zvicra
Një shtetas 33 vjeçar i Kosovës i ka dërguar një miku një dosje me pamje pornografike të fëmijëve përmes llogarisë së tij në Facebook. Për pasojë, ai tani ai duhet të largohet nga Zvicra për pesë vjet, konfirmon Gjykata e Lartë (kantonale) e Cyrihut, shkruan Agjencia e Lajmeve e Zvicrës, SDA.

Kishte mjaftuar një klikim i shpejtë – dhe ai tashmë, përmes llogarisë së tij në Facebook ia kishte dërguar një fqinji në Kosovë videon, e cila tregon dy djem të mitur duke kryer marrëdhënie orale dhe anale.
Sipas kodit penal, 33-vjeçari , duke bërë dërgimin e dosjes në fjalë ka kryer veprën penale për pornografi të rëndë, transmeton albinfo.ch. Në nëntor të vitit 2020, Gjykata e Qarkut të Cyrihut i kishte shqiptuar atij një gjobë prej 30 njësish ditore nga 80 frangaa, e cila ishte caktuar me kusht për një periudhe prove prej dy vitesh.
I akuzuari e ka pranuar dënimin në fjalë por ai ka kundërshtuar dëbimin pesë-vjeçar nga Zvicra. Por Gjykata e Lartë tashmë e ka konfirmuar vendimin e Gjykatës së Qarkut, pa e ndryshuar atë si shkallë e dytë.
Këtë e ka bërë me arsyetimin se “pornografia e rëndë” është një nga deliktet që, sipas ligjit, duhet të çojë në dëbimin e autorit nga vendi për pesë deri në 15 vjet.
Avokati i të akuzuarit nuk e ka mohuar këtë në procedurën me shkrim para Gjykatës së Lartë, përcjell albinfo.ch. Por ai, dëbimin e detyrueshëm nga Zvicra, për shkak të një shkeljeje të lehtë, e ka përshkruar megjithatë, si jo proporcional ndërsa vetë ligjin si “të pamenduar deri në fund”.
Prandaj, ai ka kërkuar të vihet në veprim “klauzola e përjashtimit”. Sipas saj, nëse dëbimi nga vendi rezulton në një vështirësi serioze personale dhe interesi privat për të mbetur në Zvicër tejkalon interesin publik të dëbimit nga vendi, dëbimi i tillë mund të anulohet.
Avokati mbrojtës gjithashtu ka argumentuar se klienti i tij drejtonte me sukses një biznes në Cyrih. Për të krijuar kompaninë e tij, atij i i ishte dashur të merrte hua nga 10,000 deri në 15,000 franga, transmeton albinfo.ch. Nëse tani do të dëbohej nga Zvicra, do të ishte i papunë dhe nuk do të mund ta kthente më borxhin.
Për më tepër, borxhet do ta bënin të pamundur që ai të krijonte një kompani të re diku tjetër.
Sipas praktikës gjyqësore të Gjykatës së Lartë Federale, dispozita e “rastit të rëndë” duhet të zbatohet në mënyrë të kufizuar, është shprehur Gjykata e Lartë në vendimin e saj, i cili tashmë ka marrë formë të prerë.
Gjykata thekson gjithashtu se i dënuari ka jetuar në Zvicër jo më gjatë se nga viti 2018 kështu që nuk ka asnjë lidhje private këtu.
“Fakti që jeta në Zvicër duhet të jetë më komode, veçanërisht nga ana ekonome, sesa në Kosovë dhe pjesërisht në vendet e BE-së, nuk përbën `rast të rëndë`”, sipas Gjykatës së Lartë.
